Divorce

Either spouse can file a petition for dissolution of marriage if at least one party has been a Florida resident for the preceding six months. Grounds for divorce in Florida include the no-fault ground of irretrievable breakdown of the marriage (irreconcilable differences), as well as mental incapacity. After making the required financial disclosures and requesting any temporary orders, the parties will enter a period of litigation. Simultaneously, the parties may attempt to resolve the issues in their divorce through mediation, which can be voluntary or court-ordered.
