Even if a parent’s biological parents consent to a stepparent adoption, if the child is over the age of 12 years old, he or she will also need to consent to the adoption. To demonstrate that consent has been given, the child will be required to sign an official affidavit, confirming the desire for the parent-child relationship. For children under the age of 12 years old, this isn’t usually required.

Parental Rights and Obligations

Finalizing a stepparent adoption means that the child’s stepparent will be granted all of the parental rights and obligations of a biological parent. As a result, the stepparent will have the right to visitation and could be obligated to pay child support in the event of divorce. The parent can also participate with the child’s biological parent in making decisions about the child’s healthcare, religion, education, and day-to-day activities.
